O-1A Visa Eligibility Criterias

What is the validity period of the O-1 visa?

Your first stay can be for a maximum of three years. You are also entitled to an additional stay of 20 days in total. 

Can I extend my visa validity period?

Yes. The O-1 visa validity period can be extended up to 1 year. There is no limit to the number of applications you can submit to extend your visa validity period. This means that you can be continuously present in O-1 status in 1-year intervals.

Can my wife work in the US?

Uh, no. Your spouse comes to the US on an O-3 visa. It is not possible to get a work permit and to be legally employed in the US with an O-3 visa.

Can my child study in the US?

Yes. Your child or children come to the US on an O-3 visa, just like your spouse. With an O-3 visa, it is possible to participate in a part- or full-time study program in the United States.

I came to the U.S. on an O-1 visa. Can I change my employer who sponsored my visa application?

Yes. For this, your new employer, like your first employer, must submit the I-129 "Petition for a Nonimmigrant Employee" form to the U.S. Immigration and Naturalization Service (USCIS). In addition, your new employer must also prepare the necessary documents to prove that they employ you.

How long does it take to finalize O-1 visa applications?

The processing time for the O-1 visa is considerably shorter than many other visas. Although this time varies from service center to service center and from year to year, the O-1 visa processing time currently averages 1.5 months. On the other hand, it is possible to reduce this time to two weeks by paying an additional fee through a processing expediting service.

Is there an annual quota for the O-1 visa?

Who can sponsor my O-1 visa application?

Any employer, institution, organization or representative agent who conducts a legal and active business operation in the United States may sponsor your O-1 visa application.

I am an independent employee, not part of a company. Who can be my O-1 visa sponsor?

If you are a freelancer, you can work through the O-1 visa application process with sponsors called "agents". An agent can be your employer or an individual or organization that represents the employer and you.

Will I need to apply for a visa after my I-129 petition is approved?

If you are already in the U.S. and are applying for a change of status to O-1, the approval of your I-129 petition will be accompanied by the approval of your O-1 status. On the other hand, if you are outside the U.S., approval of your I-129 petition does not necessarily mean that your O-1 visa is also approved. For O-1 visa approval, you must make an appointment at the U.S. consulate (in your home country or another country) and have your passport stamped with the O-1 visa stamp.
